The website agrimendes.com is owned and operated by Agri-Mendes – Agricultura e Comércio, Lda, a private limited company with its registered office at Rua São Simão, no. 108, Comeiras de Baixo, 2000-694 São Vicente do Paúl, Santarém, Portugal, share capital of €275,100.00, registered with the competent Commercial Registry under the unique registration and legal person number 502400056, email geral@agrimendes.com and telephone +351 931 428 385.

The trade name used on this website is Azeite Mendes.

2. Purpose and acceptance

These Terms and Conditions govern access to and use of agrimendes.com, the purchase of products in the online store (extra virgin olive oil and other items available) and requests for information about Agri-Mendes’ other services, including transport, biomass, straw and forage, and baling.

Using the website or completing an order means that the user has read and accepted these Terms and Conditions and the Privacy Policy. Agri-Mendes may update this document at any time. The version applicable to each purchase is the one published on the date of the order.

3. Products and information

The products shown in the store — name, description, images, stock and price — are intended to inform the customer clearly. Small differences in colour or appearance, resulting from photography or the screen, do not constitute a defect.

The prices shown include VAT at the legal rate in force. Shipping costs, where applicable, are added at checkout.

Despite care in keeping the store up to date, errors in price or stock may occur. If an error is detected, the customer will be contacted and may confirm the order at the correct price or cancel it, with a full refund of the amount paid.

4. How to buy

No account is required. The online store process is as follows:

1. Go to the Shop and choose the products you want.
2. Add the items to the cart.
3. Fill in your personal, tax and delivery details.
4. Accept these Terms and Conditions.
5. Choose the payment method and complete the order.

The contract is concluded when payment is confirmed (MB WAY) or when the Multibanco reference is generated and the order is registered, with shipment subject to confirmation of payment.

5. Delivery area

Online store orders are shipped to mainland Portugal only. Checkout does not allow another destination country.

6. Shipping costs

Shipping costs are added to every order, regardless of the order value. There is no free shipping.

Delivery times depend on the carrier and on confirmation of payment. After dispatch, the customer receives a confirmation email. The invoice is sent physically together with the order.

7. Payment

Payments are processed through Easypay, using the following methods:

• MB WAY
• Multibanco reference, valid for 24 hours. If payment is not made within that period, the order may be cancelled and stock restored.

Agri-Mendes does not store card or bank account data. The processing of that data is the responsibility of Easypay.

8. Right of withdrawal

If the customer is a consumer, they may withdraw from the contract within 14 days of receiving the products, without giving any reason, under Decree-Law no. 24/2014 of 14 February.

To exercise this right, send a request to geral@agrimendes.com, with the order number. It is sufficient that the communication is sent before the deadline expires.

The amount paid for the products will be refunded using the same payment method as the purchase, within 14 days of the communication. Agri-Mendes may withhold the refund until it receives the products or until the customer proves that they have been returned.

Returns are only accepted for products in their original packaging, accompanied by the invoice, in a condition that allows resale. The cost of return, except in the case of a defective product or an error by Agri-Mendes, is borne by the customer.

The right of withdrawal does not apply, among other cases provided for by law, to sealed goods that are not suitable for return for reasons of health protection or hygiene, if the seal has been removed after delivery.

9. Exchanges, damage and non-conformity

Upon delivery, the customer should check the condition of the packaging. If it shows serious external damage, the order may be refused without opening it. If the damage is only visible after opening, contact geral@agrimendes.com with photographs and the order number.

If the products received do not match those ordered, the complaint period is 15 days after receipt.

Food products are subject to the applicable food quality and safety rules. Manufacturing defects or non-conformities will be assessed on a case-by-case basis.

During the Christmas campaign, purchases may have longer exchange periods, announced at the time.

10. Newsletter and contacts

Subscribing to the newsletter (“I agree to receive news about Azeite Mendes”) is optional and independent of the purchase.

The form on the Contacts page is intended for information requests about products, orders or services. The processing of this data is described in the Privacy Policy.

11. User conduct and intellectual property

The user undertakes not to use the website in a way that infringes the rights of Agri-Mendes or third parties, nor to disrupt the continuity, integrity or quality of the site’s features.

All website content (texts, images, logos and the Azeite Mendes and Agri-Mendes brands) is owned by Agri-Mendes or its licensors and may not be reproduced or commercially exploited without permission.

12. Limitation of liability and force majeure

The information on the website is provided for information only and may not be exhaustive. The website may experience technical interruptions. Agri-Mendes is not liable for indirect damage arising from the use or inability to use the site, except in cases of wilful misconduct or gross negligence.

In the event of force majeure — including strikes, natural disasters, or failures of transport or communications — obligations are suspended for the corresponding period.

13. Complaints book and dispute resolution

This website uses the electronic complaints book: www.livroreclamacoes.pt.

Under Regulation (EU) No 524/2013, the consumer may use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.

The updated list of alternative dispute resolution entities, under article 17 of Law no. 144/2015 of 8 September, is available on the Consumer Portal: www.consumidor.gov.pt.

14. Applicable law

These Terms and the purchase contracts concluded through the website are governed by Portuguese law, without prejudice to the mandatory rights granted to consumers by applicable legislation.
